1/ PREAMBLE

These general terms and conditions apply between Charlotte Auzou, hello@ateliercharlotteauzou.com, SIRET 537 828 824 00038, RCS Saint Nazaire 537 828 824, hereinafter referred to as "the Seller," and any individual or legal entity, whether private or public, who accesses the website www.ateliercharlotteauzou.com, hereinafter referred to as "the User," or any individual or legal entity, whether private or public, registered on the Site to purchase a Product, hereinafter referred to as "the Customer."

 

2/ DEFINITIONS

  • "Customer": Any individual or legal entity, whether private or public, who has placed an order on the Site.

  • "Site Content": Any element published on the Site, such as texts, images, videos, or diagrams.

  • "Product": Any item of any kind sold on the Site by the Seller to Customers.

  • "Site": The website accessible at the URL www.ateliercharlotteauzou.com, including sub-sites, mirror sites, portals, and related URL variations.

  • "User": Any individual or legal entity, whether private or public, accessing the Site.

  • "Seller": Charlotte Auzou, SIRET 537 828 824 00038, acting as the publisher of the Site and its operator.

 

3/ PRODUCTS

The Seller offers sewing patterns for sale, available in paper or digital formats. Charlotte Auzou's sewing books are not available for sale on the Site.

  • Product Description: The characteristics of each Product are detailed on its respective page. Photographs and illustrations used to present the Products are for illustrative purposes only and have no contractual value.

  • Product Availability: Digital sewing patterns (PDF) are available for purchase at any time. Paper patterns can only be added to the cart if they are in stock. If out of stock, they cannot be added to the cart.

  • Gift Cards: Gift cards are digital and contain a unique code sent by email upon order validation. They are valid for one year and can be used in one or multiple purchases exclusively on the Site. They cannot be combined with promotional offers.

  • Commercialization: The Seller reserves the right to discontinue the sale of a Product without prior notice to the User or Customer.

 

4/ PRICES

In France, Product prices are displayed in euros (€), net of tax, without VAT application (Art. 293B of the French Tax Code). Based on the User's location, the currency is automatically adjusted to the Customer's local currency. The Customer can also change the currency at the bottom of the Site's page. The exchange rate used is the one applied by Shopify, calculated by multiplying the Product price by the current conversion rate, adding conversion fees, and applying rounding rules specific to each currency. The Seller cannot offer an alternative exchange rate. Shipping costs are displayed on the order confirmation page and vary depending on the order's contents. The available shipping options are detailed in Article 8 of these General Terms and Conditions of Sale. Promotional offers and discount codes cannot be combined. The Seller freely sets Product prices and the shipping costs charged to the Customer. The Seller reserves the right to modify prices at any time without prior notification to the User or Customer. The prices in effect at the time of the order apply. Once the order is confirmed, prices cannot be modified.

 

5/ ORDER

Registration on the Site is free and mandatory to place an order. Order confirmation implies full consultation and acceptance of these General Terms and Conditions of Sale. To place an order, the Customer selects the desired Products and adds them to the cart. They must ensure they have chosen the correct format for each pattern, either paper or digital. Each Product is limited to one unit per order. For requests regarding multiple quantities, the Customer must contact the Seller via email at hello@ateliercharlotteauzou.com. The Customer is responsible for the accuracy of the information provided to the Seller (email address, shipping, and billing addresses, etc.). In case of input errors in contact information, the Seller cannot be held responsible. The order is considered validated only after full payment is received. The Customer will then receive an order confirmation email at the email address associated with their account.

 

6/ PAYMENT 

Payments are fully secure and processed via PayPal or Shopify Payments. Accepted payment methods include Visa, MasterCard, Apple Pay, PayPal Wallet, and bank cards. Payments via American Express are not accepted.

  • Payment via PayPal: A PayPal account is not required to complete a purchase. Customers can also pay directly by credit card on the PayPal website without registering.

  • Transaction Security: The Seller never has access to banking details. Transactions are fully managed by PayPal or Shopify Payments, ensuring a secure payment solution.

  • Currency: Orders are payable in the selected currency. Customers can choose their preferred currency at the bottom of the Site's page.

  • Invoice: An invoice can be provided upon request by emailing hello@ateliercharlotteauzou.com.

 

7/ PROVISION OF DIGITAL PRODUCTS

Orders placed on the Site may contain digital Products for download and printing by the Customer. Once the order is validated, the Buyer receives an email within minutes containing download links. These links provide access to a .zip file containing the different pattern files in .pdf format, which can be printed or viewed on a screen. The links are also accessible by logging into the Customer's account on the Site. They are limited to 5 downloads.
The Client is advised to download and save the transmitted files on their own devices, as the Seller does not guarantee the availability of the download links for an unlimited period.
The Customer is responsible for ensuring they have the necessary computer equipment and skills to use these digital Products. The Seller is not responsible for any misuse of the files. Additionally, the Seller is not responsible for errors in the email address provided at the time of order, which may prevent the proper receipt of download links or if the message is redirected to the spam folder.

 

8/ SHIPPING AND DELIVERY

Paper sewing patterns are shipped after order validation and full payment, including shipping fees.

8.1 Geographic Area Orders are only possible for delivery and billing addresses located in Metropolitan France. The Customer is fully responsible for the accuracy of the information provided.

8.2 Preparation Time The Seller commits to shipping orders within a maximum of 4 business days. The Seller reserves the right to modify preparation and shipping times, particularly during holidays. Any changes will be communicated on the Site's homepage. This timeframe does not include the delivery period of the parcel by the carrier, which is beyond the Seller’s responsibility (see below).

8.3 Shipping Fees Shipping costs are calculated based on the weight or total amount of the order and the chosen shipping method. They are visible on the order confirmation page and displayed in euros (€), net of tax, and not subject to VAT (Art. 293B of the French Tax Code).

8.4 Package Tracking
Each shipment is assigned a tracking number, which is provided by the Seller at the time of shipment. The package can be tracked directly on the carrier’s website.

8.5 Delivery Methods
Two delivery options are available for Metropolitan France:

  • Pickup point delivery via Mondial Relay.
  • Home delivery via Colissimo.

Pickup point delivery via Mondial Relay

  • Delivery time: The carrier ensures delivery within an average of 3 to 6 business days from the date of shipment by the Seller. This timeframe may vary depending on the time of year. The Seller cannot be held responsible for delays caused by the carrier.
  • Delivery location: The Customer selects a pickup point when confirming their order on the Site. The list of available pickup points and lockers can be found at: https://www.mondialrelay.fr/trouver-le-point-relais-le-plus-proche-de-chez-moi. Once the order has been confirmed, the choice of pickup point cannot be changed. If a Mondial Relay pickup point is unavailable (closure, inability to deliver, maximum storage capacity reached, etc.), it will not be offered to the Customer.
  • Non-retrieval of package: If the Customer does not pick up their package within 5 days at a Pickup Point or at a Locker, the package will be automatically returned to the Seller by Mondial Relay.

Home delivery via Colissimo

  • Delivery time: The carrier ensures delivery within an average of 2 to 3 business days from the date of shipment by the Seller. This timeframe may vary depending on the time of year. The Seller cannot be held responsible for delays caused by the carrier.
  • Delivery location: Delivery is only possible to a residential address. Business addresses are not accepted. Once the order has been confirmed, the delivery address cannot be changed.
  • Delivery method: If the package size allows, it will be placed directly in the recipient's mailbox. In case of absence and if the package cannot be delivered to the mailbox, the courier will leave it at the local post office, with a notice left in the Customer’s mailbox. Signature upon delivery is not available.
  • Non-retrieval of package: If the Customer does not collect their package within 15 days from the post office, it will be automatically returned to the Seller.

8.6 Free Shipping
Shipping is free for any order of €80 or more (after discounts and promotional offers), but only for pickup point delivery via Mondial Relay. Home delivery via Colissimo remains chargeable regardless of the order amount.

8.7 Returns
The return process is detailed in Article 10 of these General Terms and Conditions of Sale.

8.8 Undelivered Package
If the Customer does not receive their package within the stated timeframe, they are advised to check the delivery tracking with the tracking number provided by the Seller and contact the carrier.
If an anomaly is detected (package marked as delivered but not received, incorrect address, etc.), the Customer must report the issue to the carrier and contact the Seller within 10 calendar days following the shipping date.

8.9 Damaged or Incomplete Package
Any complaint regarding a missing or damaged Product must be reported to the Seller by email at hello@ateliercharlotteauzou.com within 48 business hours after receiving the package, accompanied by photos as proof of the package’s condition and the Products.

8.10 Package Returned to the Seller
If a package is returned to the Seller due to non-retrieval within the specified timeframes at a pickup point or post office, the Customer may choose between:

  • Reshipment of the package, subject to payment of additional shipping costs.
  • A refund of the order amount, minus the initial shipping costs.


9/ RIGHT OF WITHDRAWAL

In accordance with Article L.221 of the French Consumer Code, the buyer has a period of 14 calendar days to exercise their right of withdrawal.

  • Physical Products: For items purchased in paper format on the Site, this period starts from the date of receipt of the Product by the Customer. The Customer then has 14 calendar days to return the Product, unused and in perfect condition. Return costs are borne by the Customer. The return process is detailed in Article 10 of these General Terms and Conditions of Sale.
  • Digital Products: For digital Products (PDF sewing patterns), as they are provided on an intangible medium, the Customer expressly acknowledges waiving their right of withdrawal upon the first download of their order.


10/ RETURNS

For sewing patterns in paper format shipped via Mondial Relay or Colissimo and marked as delivered, returns are possible under the following conditions:

10.1 Return Conditions
Returns are accepted within 14 days after receiving the order, in accordance with Article L.221 of the French Consumer Code (see Article 9). Returned Products must be unused, in perfect condition, and complete in their original packaging.

10.2 Return Request
The Customer may submit a return request through their customer account within the applicable time limit. To do so, they must go to the "My Orders" section, select the relevant order, then click "Manage" and "Return Items".
The Seller will review the request and notify the Customer of its approval or rejection in accordance with these Terms and Conditions of Sale.

10.3 Return Shipping
Return shipping costs are the responsibility of the Customer, except in cases of shipping errors attributable to the Seller. Returns must be sent using a tracked shipping method to the address provided by the Seller. The Seller is not responsible for lost or damaged packages during return shipping.

10.4 Refund
After receipt and verification of the returned items, the refund will be processed as soon as possible and within a maximum of 14 calendar days via the same payment method used for the purchase. Initial shipping costs are non-refundable, except in cases of Seller error.
If the digital product (PDF pattern) associated with the physical product (paper pattern) has been downloaded (download count more or equal 1), only the amount corresponding to the difference between the VAT-inclusive prices of the two product variants will be refunded to the customer.

10.5 Exchange
No exchanges are possible. The Customer must return the Product and place a new order if they wish to receive a different item.


11/ CUSTOMER SERVICE

For any questions regarding Products, orders, shipping, or downloading digital Products, customer service is available Monday to Friday (excluding public holidays) via email at hello@ateliercharlotteauzou.com or through the Site’s contact form.
The Seller commits to responding within a maximum of 72 business hours, unless otherwise stated on the Site. The Seller is not responsible for incorrect email addresses provided by the User or if the response is redirected to their spam folder.


12/ LIABILITY

The Seller cannot be held liable for any damages related to the use of the sewing patterns sold or the content shared on the Site (assembly errors, incorrect size choice, incorrect print scaling, etc.). Furthermore, although the Seller strives to provide clear and precise content, potential typographical errors do not constitute grounds for claims by the User or Customer.


13/ PERSONAL DATA

Information requested by www.ateliercharlotteauzou.com is necessary for order processing. To respect your privacy, the information you provide is never shared, sold, or rented to other companies or organizations.
In accordance with the French Data Protection Law No. 78-17 of January 6, 1978, the Site is registered with the CNIL under number 2020628. Customers have the right to access, modify, oppose, and delete their personal data.


14/ INTELLECTUAL PROPERTY

All content on the Site (images, texts, products) is protected under copyright law. Any distribution, exploitation, reproduction, or representation, whether partial or complete, without the explicit authorization of the Company, may result in civil and criminal proceedings.


15/ GOVERNING LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed by French law.
In case of a dispute, the Customer is invited to contact customer service to seek an amicable resolution. If no agreement is reached, the Customer may refer the matter to a consumer mediator.


16/ MODIFICATION OF TERMS AND CONDITIONS

The Seller reserves the right to modify these terms and conditions at any time, with immediate application to future orders.
